Message from the President

Happy summer to you all! Your Board of Directors keeps working, even through the summer months. We have been meeting at the JCC through August, and will be back at the Foothills High School for the September 11th meeting (postponed because of Labor Day).

I am happy to report that we are getting signed consent forms at a pretty steady pace. Kuddos to Irene Barg and Pat Tapke for their work in getting people to hold signing parties and for just plain getting things done. I also want to commend Brian Bickel for his not only getting things done in a timely manner, but catching when we don’t receive our payments due from closing sales. Brian has also done stellar work to bring our accounts receivable as current as possible. The roads committee has had to back off a little until we can get the legal process of how we accomplish the work necessary in line. Architectural and CC&R enforcement are continually working to get and keep us in compliance.

In short, we have a wonderful and very active Board of Directors and committee members. That being said, it is time to start looking at the election that takes place in November. According to our governing documents, we need to get a nominating committee in place in the next month or so. We also need people willing to step up and into the positions available. We currently have one vacancy on the board. Sadly Laura Sheets has moved from Tucson to follow her husband on his new assignment. Although they are not selling their Cluster’s home, she will no longer be able to be on the board after the current year. 

This is the last of my three-year term and I will probably not be able to run for the board this fall. That gives us at least three vacancies to fill. In addition to that, I was just informed that Jeff Servoss will be completing his three-year stint on the Master Association Board and is not interested in continuing to serve there. We need people to come forward and help continue the great work YOUR BOARD of DIRECTORS has done. We have so much further to go. Please consider working with your community to help The Foothills Clusters continue to move forward.

Editor's Comments

The subject of barking dogs in the neighborhood has been raised with the board many times recently. Several neighbors have complained that incessant noises are spoiling the peace and causing stress. The board is evaluating appropriate responses and process. Please see the article below. More details to follow in the Fall Newsletter.

The board continues to move forward with the next step to fixing the roads, which is to lighten the process for voting on necessary CC&R changes. See details below on the Consent Form signing campaign now in progress.

FCHOA Consent Form Signing Campaign

We are still collecting signed consent forms from our members. We are pleased to report we currently have signed forms representing 102 lots, but we still need to receive signed forms representing another 174 lots in order to reach the required 75% (276 homes). 

The proposed amendment allows subsequent changes to the CC&Rs with the approval of a simple majority of homeowners. It also eliminates the requirement that all persons named on the title sign the consent form in the presence of a notary. A copy of the amendment and consent form has been included in this Newsletter, and can be downloaded from: to CC&Rs.pdf

There are three ways you can formally consent to this CC&R update:

MAIL: You, and all persons named on the title, bring the consent form to any notary public such as those on staff at your own bank. (Also bring your government-issued photo IDs). Then, mail your signed and notarized from to:

Landscape and Roads Committee

We are getting requests from homeowners for pothole repairs on our private streets (excludes Evans Mountain Dr. & Ventana Canyon Dr.). Since the monsoon rains contribute to the deterioration of potholes, we will mark them, but will wait until after the monsoon season to patch them.

To facilitate this effort, I would like for all members to report potholes in their neighborhood to:, Subject: Potholes.

Nominating Committee

The annual meeting of the Foothills Clusters Homeowners Association is set for Sunday, November 5, 2017. Pursuant to our By-Laws, a Nominating Committee was appointed by the Board of Directors at least ninety (90) days prior to the annual meeting or by August 7, 2017.

The nominating Committee consists of a Chairperson, who must be a member of the Board of Directors, and two or more Members, none of whom shall be a spouse, relative or household member of any Director.

Dumpsters will be dropped off on Fridays and picked up on Mondays as follows:

  • November 4-5
  • November 11-12

A personal Guide to Barking Dogs

Excessive barking is continuing to diminish the quality of life in the Clusters for many residents. Many of us chose to live here to enjoy peace and quiet, and we all have a right to enjoy the area’s natural serenity in and outside our own homes. While no reasonable person would expect a dog to never make noise, excessive barking is problematic in numerous ways:

  • Exposure to barking causes stress and anxiety in many people, as well as headaches and potentially debilitating health problems. It disrupts sleeping children (and adults!), and human productivity.
  • Excessive barking often indicates that your pet is unhappy, bored, or ill.
  • Excessive barking is prohibited by the Foothills Clusters CC&Rs, is a violation of Pima County noise ordinances, and can result in a fine of up to $500 and the eventual removal of the dog by Pima Animal Care Center (PACC).

You are encouraged to first speak with the dog’s owner as they may not be aware of the problem or not realize that is it affecting neighboring residents.

Residents should document the address of the dog, the time and duration of the barking and if you have spoken with the owner. If dogs at more than one address are involved, please send separate emails for each address to:

(Note: Since there are no volunteers to chair or staff the CC&R Compliance Committee, the Architectural Control Committee is handling this additional duty.)

The HOA board is pursuing allowable enforcement procedures with its attorneys. Details to follow.
